Terms of Use

  • Article 1. Agreements
  • 1.1 These Terms and Conditions govern the rights, obligations, and responsibilities of users in connection with the Internet and mobile app services (hereinafter referred to as the “Services”) provided by tourvate.com (hereinafter referred to as “Tourvate”), which is operated by Aid Co., Ltd. (hereinafter referred to as the “Company”).
  • 1.2 “Tourvate” refers to the website or virtual online marketplace created by the Company to enable users to access products and services offered by the Company or its affiliates.
  • 1.3 “Users” refers to anyone who accesses Tourvate or wishes to purchase any of its services.
  • 1.4 These Terms and Conditions apply between the User and Tourvate. By using Tourvate’s Services, the User is also bound by any additional provisions related to the Services updated from time to time, including Tourvate’s Privacy Policy, promotional benefits, event rules, and other applicable guidelines, all of which form part of these Terms and Conditions.

  • Article 2. Revision of Terms and Conditions
  • 2.1 The Company will display information such as the company name, representative’s name, address (including customer center address), and phone number on the main page of the website for users’ reference. Additional details, such as phone numbers, email addresses, business registration numbers, online sales registration numbers, and the personal information protection officer’s information, may be displayed on a separate linked page.
  • 2.2 The Company may revise these Terms and Conditions at any time to the extent permitted by applicable laws and regulations, without prior notice.
  • 2.3 Applicable laws include: the Act on Consumer Protection in Electronic Commerce Transactions, the Regulation of Standardized Contracts Act, the Act on the Promotion of Information and Communications Network Utilization, the Digital Signature Act, and related regulations governing information and communications networks and door-to-door sales.
  • 2.4 When the Terms and Conditions are revised, the Company will post a notice on the main page of the website at least seven (7) days before the effective date, stating the date of application and the reason for revision. Notice will also be sent to users via email. If a user does not raise an objection within four (4) weeks of such notice, the user is deemed to have agreed to the revised Terms and Conditions.

  • Article 3. Services
  • 3.1 Tourvate provides users with easy and convenient access to itinerary planning, pickup services, tickets, and other travel experience services offered by Tourvate or third-party vendors (hereinafter “Suppliers”) partnered on the Tourvate platform. To the maximum extent permitted by law, the Company reserves the right to modify, suspend, or terminate the Services at any time, and to add, restrict, or amend provisions for individual Services, including partial or full restrictions on a user’s access to the Services, without prior notice.
  • 3.2 Users may be required to pay Suppliers directly for certain services and to comply with the Supplier’s own terms of service. Users agree to bear full responsibility for such costs and to comply with all applicable terms and conditions.
  • 3.3 Tourvate will compensate users for damages caused by Tourvate, except in cases where Tourvate is proven to have acted without intent or negligence.

  • Article 4. Content
  • 4.1 “Content” in these Terms and Conditions refers to any material displayed or used by the Company on Tourvate, including text, photographs, graphics, images, illustrations, videos, audio, data, program code, and other materials. All Content is the exclusive property of Tourvate or parties who have licensed its use to Tourvate, and is protected under applicable intellectual property laws. Tourvate reserves the right to modify, update, or remove any platform Content at any time without prior notice.
  • 4.2 Subject to these Terms and Conditions, the Company grants you a limited, non-exclusive, non-transferable license to use or access Tourvate, which may be revoked at any time without prior notice. You agree to comply with all applicable intellectual property laws and regulations. Content may only be used or accessed for personal, non-commercial, and entertainment purposes. You agree not to use, reproduce, translate, transmit, broadcast, sell, transfer, create derivative works from, or otherwise exploit any platform Content in any manner that harms Tourvate or its authorized rights holders. You agree to assume all risks associated with your use of or access to Content, and to the extent permitted by law, the Company shall not be liable for any errors or omissions in the Content. You are solely responsible for any loss or damage arising from your use of or access to the Content.
  • 4.3 As the Company may not be able to identify or predict the behavior of third-party users, Tourvate cannot guarantee the authenticity or accuracy of content, data, or information provided by third parties on the platform.

  • Article 5. Registration and Confirmation
  • 5.1 Users are required to provide accurate, current, and complete information in accordance with the registration form provided by Tourvate.
  • 5.2 The service agreement takes effect from the time the user receives approval from Tourvate.
  • 5.3 Users are obligated to notify Tourvate of any changes to their registered information via email or other available means.

  • Article 6. Termination of Contract
  • 6.1 Users may apply to Tourvate for termination of the contract at any time. However, all existing transactions must be completed, withdrawn, or canceled prior to submitting a termination request. The user is solely responsible for any losses arising from the withdrawal or cancellation of transactions. The Company reserves the right to reclaim any benefits provided to users upon membership withdrawal.
  • 6.2 Tourvate may, at its sole discretion, deactivate or suspend a user’s account at any time, with or without reason or prior notice, and without liability to the user, in the following cases:
  1. The user provided false or misleading information during registration.
  2. The user fails to fulfill payment obligations in whole or in part.
  3. The user violates online commerce regulations, such as disrupting other transactions or misappropriating other users’ information.
  4. The user violates any obligation under these Terms and Conditions or applicable laws.
  5. The user exchanges contact information with other users and conducts transactions outside of Tourvate, solicits other users to leave the platform, or arbitrarily cancels a rental agreement.
  6. The user causes significant harm to the Company.
  • 6.3 Tourvate may, at its sole discretion, permanently terminate a user’s account without prior notice in the following case:
  1. The user repeats the conduct that led to account deactivation or suspension, or fails to remedy such conduct within thirty (30) days.

  • Article 7. Notices
  • 7.1 All notices and communications related to the Services may be delivered to the user via email at the address provided by the user.
  • 7.2 Notices intended for unspecified users may be substituted by posting on the website for a minimum of one (1) week. However, notices regarding important membership or transaction matters will be sent to users individually.

  • Article 8. User Obligations
  • 8.1 Users are responsible for providing accurate, current, and complete information and must provide all items deemed necessary by Tourvate.
  • 8.2 Users bear full responsibility for the accuracy of information they submit on Tourvate.
  • 8.3 User content stored on Tourvate may not be reproduced or distributed without the prior consent of the content owner. However, content may be indexed by search engines or other automated mechanisms.
  • 8.4 By accessing or using the website, users acknowledge that they have read, understood, and agreed to comply with these Terms and Conditions. Any damage resulting from a user’s failure to review the Terms and Conditions is solely the user’s responsibility.
  • 8.5 Users must use payment methods that correspond to their own billing information and may not use the billing information of third parties. Users are fully responsible for any losses or damages arising from the unauthorized use of a third party’s payment information.
  • 8.6 Users are solely responsible for any charges or disadvantages resulting from the billing information they have provided.
  • 8.7 The Company reserves the right, at its sole discretion, to obtain pre-authorization to verify the validity of a user’s payment method, and to suspend or cancel transactions pending such authorization.
  • 8.8 In the event that a minor enters into a transaction, the minor or their legal guardian has the right to cancel the contract if the legal guardian has not consented to it.

  • Article 9. Orders, Payments, and Cancellations
  • 9.1 Users may make purchases through the Tourvate website or mobile app.
  • 9.2 Users are responsible for paying all applicable prices at the time of order. Payment may be made by credit card or other payment methods approved by Tourvate.
  • 9.3 If a purchased voucher is not activated or used within seven (7) days of the purchase date, a refund may only be processed through the website.
  • 9.4 Penalties may apply if a user cancels an existing contract.

  • Article 10. Reviews and Evaluations
  • 10.1 Tourvate allows users to post reviews of its services. Reviews are not moderated by Tourvate and may contain inaccurate or misleading information.
  • 10.2 Users are obligated to make only truthful statements in their reviews and must comply with applicable laws. Reviews must not infringe upon the rights or privacy of third parties, and must be objective and free from defamatory content.
  • 10.3 The misuse of the review system is prohibited. In particular, users are prohibited from using the review system for purposes unrelated to transactions conducted on the website, including incorporating reviews into unrelated matters or manipulating the review process.
  • 10.4 Tourvate does not intervene in the review system. Reviews will not be altered or removed by Tourvate and are final upon publication. Reviews are permanently saved to the user’s feedback profile and are visible to all users. Users may be legally liable for defamatory, vulgar, obscene, or discriminatory content in their reviews. As Tourvate does not screen or verify reviews for accuracy, Tourvate cannot be held legally liable for user-posted content, even if defamatory.
  • 10.5 Tourvate may remove a review in the following circumstances:
  1. Removal is required by an enforceable court order against the person who posted the review.
  2. The review contains vulgar, obscene, racist, age-inappropriate, or criminally offensive content.
  3. The review contains another user’s personal information, such as name, address, phone number, or email address.
  4. The review contains links or scripts.
  5. A user has inadvertently posted a negative review targeting the wrong user and has since corrected the error by posting the review to the correct user.
  6. The review was posted by a minor at the time of the transaction or at the time of posting.
  • 10.6 If both parties mutually agree, a posted review may be withdrawn. Upon withdrawal, the review will be deleted from the account’s feedback profile, though any related comments will be retained and updated to reflect the withdrawal.

  • Article 11. Duration and Termination
  • 11.1 If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. These Terms and Conditions will remain in effect between the user and Tourvate until terminated by the Company. In the event of a violation of these Terms and Conditions, or if the Company deems it necessary, the Company reserves the right to immediately terminate or suspend the user’s access to Tourvate’s Services or membership account without prior notice.
  • 11.2 Upon termination of these Terms and Conditions in accordance with Article 11.1, the Company shall have no obligation or liability to the user to the maximum extent permitted by law, and may cancel any pre-termination orders without issuing a refund.
  • 11.3 Upon termination of these Terms and Conditions, certain provisions may survive termination depending on their nature, including but not limited to limitations of liability.

  • Article 12. Dispute Resolution
  • 12.1 Any dispute, claim, or controversy arising out of or relating to the breach, termination, enforcement, interpretation, validity, or use of these Terms and Conditions or the Services (collectively, “Disputes”) shall be submitted to the court having jurisdiction over the user. If the user’s jurisdiction is unclear or the user resides outside of Korea, the dispute shall be filed with the competent court as determined under the Civil Procedure Act.
  • 12.2 Korean law shall apply to all disputes and legal proceedings related to e-commerce between Tourvate and its users.

  • These Terms and Conditions were published in February 2024 and take effect from the date of publication.
